Penalties for a Conviction for Driving with a Suspended License

  • First-Time Offenders – This would be considered a Class A misdemeanor. You will have to spend 10 days in jail and may also have to do 30 days of community service. Depending on your situation, you may face up to one year behind bars and fines of up to $2,500.
  • Second or Third-Time Offenders – If this is not your first rodeo and you have been arrested for driving with a suspended driver’s license before, it will be considered a Class 4 felony. The legal consequences are more severe. You could be looking at a mandatory sentence of a month in jail or 300 days of community service. In more severe cases, you could wind up in prison for up to three years. 
  • Fourth-Time Offender – The court may seize the license plates of the person’s vehicle or make sure that you are not able to move the vehicle on top of additional penalties. If you have any prior violations and cause an accident in which there are injuries or someone dies, it will be considered a Class 4 felony.
